In New York, immigration assistance providers are required to comply with New York City Administrative Code, Title 20, Chapter 5, Subchapter 14: Immigration Assistance Services. To compensate victims of fraud, immigration assistance providers are required to hold a $50,000 surety bond. The bond obligee is the City of New York. This is a continuous bond, but it may be canceled by the surety company with a 60-day written notice. 

The customer may cancel the contract within three business days of signing, without fee or penalty. If canceled after three days (or within three days if waived), the provider may retain fees for services provided and any expenses incurred on the customer's behalf. All other amounts must be refunded within fifteen days. This notice should be submitted to the New York Department of Consumer Affairs and the principal.

To comply with the law, immigration assistance providers must maintain the bond. To maintain your immigration assistance service provider bond, you must pay the premium annually. To assist you with this, we will be in touch annually with payment instructions.

Immigration assistance providers are not required to register with the state or get licensed. However, there are established regulations that they must follow. These include:
 

• Post a $50,000 surety bond
• Provide a written contract to clients in English and their native language outlining fees and services
• Have a 3-day cancellation policy with a full refund
• Provide clients with a written copy of all documents provided to the government
• Keep the documents for three years and provide them to clients upon request at no cost
• Notify clients that they are not an attorney and cannot provide law services
