Immigration Assistance Service Providers Bond Requirements in New York
In New York, immigration assistance providers are required to comply with New York City Administrative Code, Title 20, Chapter 5, Subchapter 14: Immigration Assistance Services. To compensate victims of fraud, immigration assistance providers are required to hold a $50,000 surety bond. The bond obligee is the City of New York. This is a continuous bond, but it may be canceled by the surety company with a 60-day written notice.
The customer may cancel the contract within three business days of signing, without fee or penalty. If canceled after three days (or within three days if waived), the provider may retain fees for services provided and any expenses incurred on the customer's behalf. All other amounts must be refunded within fifteen days. This notice should be submitted to the New York Department of Consumer Affairs and the principal.
